1. Who you are agreeing with
This service is operated under the brand RentPlace at rentplace.com. "RentPlace", "we" and "us" mean that service. "You" means the person or organization using it, whether as a landlord, a property manager or a renter. Notices to us go to support@rentplace.com.
2. What the service is
RentPlace is a rental listing marketplace. Landlords and property managers publish listings, set screening questions and receive structured inquiries. Renters search listings and send inquiries. RentPlace is a venue and a set of tools. It is not a party to any tenancy, it does not act as a broker or an agent for either side, and it does not guarantee that any unit will be let or that any applicant will be accepted.
RentPlace is not a consumer reporting agency. It does not perform credit checks, criminal background checks or consumer reports, and nothing on this site is legal advice.
3. Accounts
You must give an accurate email address and keep your login details to yourself. You are responsible for what happens under your account. Tell us promptly if you think someone else has access to it. We may suspend an account that is being used to break these terms.
4. Plans, billing and cancellation
All plans are paid. There is no free plan. Fees are stated on the pricing page and are charged monthly or annually in advance depending on the plan you choose. Plans renew automatically until you cancel.
You can cancel at any time and your plan will run to the end of the period you have already paid for. Payments are final and partial periods are not pro-rated; the narrow cases in which we correct a charge are set out in the refund policy. If we change prices we will give account holders at least 30 days notice before the change applies to them, and you may cancel before it takes effect. Taxes are added where they apply.
Renewals and failed payments. Your subscription renews automatically until you cancel it. When a new billing period begins, access for that whole period is granted and the payment for it is due. If the charge does not go through, the payment remains due and we retry it. Cancelling after a new period has begun only switches off later renewals; it does not cancel the payment for the period that has already started. Such a renewal charge is not refundable, and your access continues until the end of that paid period. The fee is for access to the service for the period, not for using it, so not having used the service is not a ground for a refund.
5. Your content
Listings, photographs and messages you upload stay yours. You give us the license we need to host, display, index and distribute them for the purpose of running the service, including publishing listing pages that search engines can crawl. You confirm that you have the right to let a property you list and the right to use the photographs you upload.
6. Acceptable use
Do not use RentPlace to:
- advertise a property you do not have the right to let, or a property that does not exist;
- state a rent, deposit or availability date you do not intend to honour;
- collect application fees or deposits through the inquiry system;
- scrape, resell or redistribute listings or renter data;
- send unsolicited commercial messages to renters who inquired about a listing;
- attempt to break, overload or probe the service or anyone else's account.
7. Fair housing and screening
Listings and screening criteria must comply with the Fair Housing Act and with the state and local fair-housing rules that apply to you. Do not publish a listing or apply a screening rule that discriminates on a protected characteristic. RentPlace helps you ask every applicant on a listing the same questions, but the criteria and every decision remain entirely yours and you are responsible for them.
8. Renters
Using RentPlace as a renter is free. Answer screening questions honestly. Do not send inquiries you have no intention of following up, and do not use the inquiry channel to advertise anything. Your answers go to the landlord or manager of the listing you contacted, as described in the privacy policy.
9. Availability
We work to keep RentPlace available. We do not guarantee uptime and there is no service level agreement on any plan; the service is provided as it is. We may change or discontinue features, and where a change materially reduces what you are paying for we will tell account holders in advance.
10. Liability
To the extent the law allows, RentPlace is not liable for indirect or consequential loss, for lost rent, for lost profit, or for anything arising from a tenancy, an applicant or a landlord you found through the service. Our total liability in any twelve month period is limited to the fees you paid us in that period. Nothing here excludes liability that cannot legally be excluded.
11. Ending the agreement
You may stop using RentPlace and cancel your plan at any time. We may suspend or close an account that breaks these terms, and we will tell you why. When an account closes, your data is handled as described in the privacy policy, and you can export your listings and inquiries before you go.
12. Changes to these terms
If we change these terms materially we will update the date at the top of this page and notify account holders by email before the change takes effect. Continuing to use the service after that means you accept the new version.
